    One Chef Spoke Up

One Chef Spoke Up. An Entire Workforce Benefited.

How Unichef helped protect the established payday of an entire catering workforce during a TUPE transfer.

Another positive outcome for Unichef – The National Chefs Union.

When a group of chefs and catering staff learned that their employment was transferring to a new contract catering company, they naturally had questions about what the change would mean for their working lives.

For most, the transfer itself was not the problem. The concern was something much simpler, but equally important: their payday was about to change.

For years, employees had received their wages at the end of each month. Like millions of working people, they had organised their mortgages, rent, household bills and direct debits around that arrangement.

The incoming employer, however, operated a different payroll system and intended to move their payday to the 10th of each month.

Although their salaries would remain unchanged, the proposed alteration threatened to create very real financial difficulties.

    One Chef Raises the Alarm

One of the affected employees, a Unichef member whom we will call Chef K, contacted the union for advice.

He was understandably concerned. His wages might remain the same, but changing when he received them could make meeting his regular financial commitments extremely difficult.

Initially, the incoming employer explained that its existing payroll system operated on the 10th and that maintaining a separate arrangement for the transferring employees would create additional administrative work.

It also offered employees a salary advance to assist with the transition.

While this was intended to help, it did not resolve the fundamental concern. Employees did not want to borrow money or rearrange their financial commitments simply because their employer was changing.

    Understanding Their Rights

Unichef examined the circumstances, including the member's existing contract and the protections available under the Transfer of Undertakings (Protection of Employment) Regulations, commonly known as TUPE.

TUPE is designed to protect employees when a business or service transfers between employers. Existing contractual terms normally transfer with the employees, although the extent of protection for a particular payday arrangement can depend on the contract and established working practices.

We also considered the requirements for employers to inform and consult affected employees about proposed measures, including changes to salary payment arrangements.

    Our approach was deliberately measured.

Rather than immediately alleging wrongdoing, we encouraged our member to seek clarification, explain the financial consequences and give the incoming employer an opportunity to reconsider.

The aim was never to create a dispute. It was to find a fair solution.

    From One Voice to Many

As discussions continued, it became clear that Chef K was far from alone.

The proposed change affected approximately 20–30 chefs and catering employees, many of whom shared the same concerns.

With guidance from Unichef, Chef K helped bring his colleagues together and organised a collective letter requesting that their established end-of-month payday be retained.

The letter was supported by the majority of the workforce.

It was respectful, constructive and made one thing absolutely clear: employees were not opposed to the transfer or their new employer. They simply wanted their existing payment arrangements honoured.

This collective approach helped demonstrate that the issue was not an isolated personal difficulty, but a genuine concern affecting much of the workforce.

    A Constructive Dialogue Produces Results

The incoming employer initially maintained that operating a separate payroll cycle would create administrative difficulties. However, following further correspondence, the collective request was referred to its specialist TUPE team for consideration.

Throughout the process, Unichef continued advising Chef K, helping him understand the employer's responses and ensuring that the employees' concerns were clearly and professionally presented.

And then came the news everyone had hoped for.

The incoming employer agreed that the transferring employees would continue to receive their wages at the end of each month.

The proposed change to the 10th would no longer be imposed on the workforce.

It was an excellent outcome, achieved without formal proceedings or unnecessary confrontation. Importantly, the incoming employer deserves recognition for listening to the employees' concerns and agreeing to a practical solution.

    A Victory for Common Sense

This case demonstrates something we have long believed at Unichef: not every workplace disagreement needs to become a battle.

Sometimes the most effective approach is to understand the law, identify the real problem and encourage both sides to find a workable solution.

Chef K deserves considerable credit for raising the issue, bringing his colleagues together and remaining constructive throughout. His willingness to speak up helped achieve an outcome benefiting far more people than himself.

For Unichef, this was particularly satisfying. Our direct advice and support were provided to one member, yet the eventual outcome benefited an entire catering workforce.

That is what effective representation can achieve.

    The Unichef Approach

Unichef was established to represent chefs and promote better working relationships throughout the hospitality and catering industry. We believe that understanding employment rights and encouraging responsible employers to act fairly are essential parts of that work. In this case, nobody needed to lose.

The incoming employer could proceed with the transfer, employees retained the payday arrangements they depended upon, and everyone could begin their new working relationship on a more positive footing.

One chef had the confidence to speak up. His colleagues stood alongside him. And together, with Unichef's guidance, they achieved something worthwhile.

That is a success worth celebrating.
